The terms “we”, “us” and “our” refer to Play Pack, a South African business operating this website and online store.

Play Pack operates this store and website, including all related information, content, features, tools, products and services (collectively, the “Services”) in order to provide you, the customer, with a curated shopping experience. Our online store is hosted and powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions, together with any policies referenced herein (including our Privacy Policy and Refund Policy) (“Terms”), govern your access to and use of the Services and set out your rights and responsibilities.

By accessing, browsing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Returns and refunds are governed by our Refund Policy, which complies with the Consumer Protection Act 68 of 2008 (CPA).

Purchases are intended for personal or household use only and not for resale unless expressly agreed in writing.

SECTION 4 – PRICING, TAXES AND PAYMENT

All prices are displayed in South African Rand (ZAR) unless stated otherwise.

Prices include VAT where applicable, unless expressly stated. Delivery fees are displayed separately at checkout.

We reserve the right to correct pricing errors and cancel orders affected by such errors, in which case you will be notified and refunded.

You guarantee that you are authorized to use the payment method provided and that all payment information is accurate.

SECTION 5 – DELIVERY AND RISK

Delivery times are estimates only and are not guaranteed.

Risk of loss passes to you upon delivery to the address provided, in accordance with the Consumer Protection Act. We are not responsible for delays caused by couriers, customs, strikes or events beyond our reasonable control.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services, including text, images, graphics, videos, logos, product designs and trademarks, is owned by or licensed to Play Pack and is protected under South African intellectual property law, including the Copyright Act and Trademarks Act.

You may use the Services for personal, non-commercial purposes only. Any reproduction, distribution or commercial use without written permission is prohibited.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to third-party tools or services that we do not control. These are provided “as is” and at your own risk. We accept no liability arising from your use of third-party tools.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

This store is powered by Shopify. However, all purchases are made directly with Play Pack. Shopify is not responsible for any aspect of sales between you and Play Pack, and you release Shopify from any related claims.

SECTION 10 – PRIVACY AND POPIA

All personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy.

By using the Services, you consent to the lawful collection, processing and storage of your personal information, including processing by Shopify and service providers that may be located outside South Africa, subject to appropriate safeguards.

SECTION 11 – FEEDBACK AND REVIEWS

Any feedback, reviews or suggestions submitted grant us a royalty-free, perpetual license to use such content for business and marketing purposes. You warrant that your feedback does not infringe third-party rights or contain unlawful content.

We reserve the right to correct errors or inaccuracies and to update information or cancel orders affected by such errors at any time.

These Terms constitute the entire agreement between you and Play Pack regarding use of the Services.

SECTION 21 – GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of South Africa.
You consent to the jurisdiction of the South African courts.

Headings are for convenience only and do not affect interpretation.

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
